THESE TERMS AND CONDITIONS WILL SUPPLEMENT THE TERMS AND CONDITIONS OF ANY APPLICABLE OVERRIDING SIGNED AGREEMENT BETWEEN YOU AND MAGELLAN OR, IN THE ABSENCE OF SUCH AN AGREEMENT, MAGELLAN'S STANDARD TERMS AND CONDITIONS OF SALE.
Magellan's Take-Back Program provides a way for consumers to recycle certain Magellan equipment.
As part of this program, all Magellan GPS models will be accepted.
Before you mail your GPS device to Magellan, you are responsible for completely discharging your GPS device's battery.
You are responsible for mailing the device to the correct address.
Once mailed, the GPS device will not be returned to you.
You will ensure that the material mailed is only GPS devices and no other device or materials.
You are responsible for all confidential data that may be stored on the GPS device. Before you mail the GPS device for recycling, you are responsible for: (a) deleting the data on the GPS device; (b) backing up or transferring any data prior to deletion; and (c) removing any removable product that you do not want to return, such as accessories and chargers. Magellan does not accept liability for lost or confidential data or returned removable products.
NO CONTAMINATED DEVICE: This service is not intended for devices that are or have become contaminated or suspected of being contaminated with chemicals, biological agents or other substances that are not integral to the original new equipment or otherwise associated with normal office or household environments. GPS devices that may be contaminated must be decontaminated prior to recycling. Magellan does not offer decontamination services.
If you fail to comply with any of these terms and conditions, then Magellan is not obligated to recycle the device. In addition, the US Postal Service may refuse shipment and you may incur additional fees.
Warranty. MAGELLAN MAKES NO WARRANTY WITH RESPECT TO THIS SERVICE AND DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. SOME STATES DO NOT ALLOW LIMITATIONS ON WARRANTIES, SO THE LIMITATIONS IN THIS PARAGRAPH MAY NOT APPLY TO YOU.
Limitation of Liability. MAGELLAN SHALL NOT BE LIABLE FOR ANY LOSSES RESULTING FROM YOUR PARTICIPATION IN THIS PROGRAM, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.
Magellan is not responsible for any consequences related to your failure to delete personal information.
By returning your GPS device to Magellan, you relinquish ownership rights to that GPS device.
Magellan has no obligation to return the GPS device or any accessory to you.
You will not be provided with any replacement equipment or service credit for any returned GPS.
Magellan does not represent that you are eligible for a charitable tax deduction as a result of using this service.
Magellan's Take-Back Program is only valid in the continental United States.
Neither party will be liable for its failure to fulfill any obligation under these terms and conditions due to causes beyond its reasonable control.
